Cancellation & Returns Policy

Original paintings are unique works. Once a painting is sold the website shows SOLD and it can no longer be purchased.

For online purchases of standard original paintings, the statutory withdrawal right under Danish consumer law normally applies. Where it applies:

• you normally have 14 days from receiving the artwork to notify us that you wish to withdraw from the purchase;
• after notifying us, you normally have a further 14 days to return the artwork;
• you are responsible for the artwork while it is on its way back to us;
• return shipping is paid by you, as disclosed here, where this is legally permitted;
• the artwork must be returned safely and appropriately packaged — ideally in its original packaging;
• if the artwork has been handled beyond what is necessary to inspect it, you may be responsible for any reduction in its value, where permitted by law.

Approved refunds are handled according to applicable Danish consumer law. You do not need to give a reason when exercising a statutory withdrawal right.

Each workshop has a specific date, time, location and number of available places, and your booking reserves a place for you. The following is the studio's own cancellation policy.

More than 7 days before the workshop

You may request either:

• a transfer to another available workshop date, or
• cancellation and a refund where this applies under the agreed booking terms and applicable law.

Less than 7 days before the workshop

Normally no cash refund is offered under the studio's cancellation policy. Where possible you may instead:

• transfer the booking to another person, or
• request a transfer to another available date.

Any transfer is subject to availability.

No-show

If you do not attend without notifying us in advance, the booking is normally non-refundable under the studio's cancellation policy, subject to mandatory applicable law.

If the studio cancels

If Art Studio & Workshops Sydhavn cancels a workshop, you may choose either a full refund or a transfer to another available workshop date. No cancellation fee is charged when the cancellation is made by the studio.

Statutory rights for dated experiences

The policy above is the studio's voluntary cancellation policy and is separate from your statutory rights. Under Danish law, the ordinary 14-day online withdrawal right does not necessarily apply to leisure services provided on a specific date or during a specific period, which is the case for workshops and events. It is therefore not correct to assume that every workshop booking carries a statutory 14-day cancellation right. Where a statutory right does apply to your booking, it always takes precedence over this policy.

Where practical you may transfer your booking to another person. Please notify alessia.artista@gmail.com before the workshop.

The replacement participant must provide any information required for the booking. Transfers are subject to available capacity and reasonable administrative requirements.

The studio's default cancellation policy for private and company events:

More than 14 days before the event

Cancellation may be eligible for a refund, subject to the agreed booking terms and any clearly disclosed non-refundable costs.

7–14 days before the event

Rescheduling is offered where reasonably possible. Any refund depends on the agreed event terms and on costs already incurred.

Less than 7 days before the event

The booking is normally non-refundable under the studio's cancellation policy, because materials, preparation and staffing may already have been committed.

This policy does not limit any mandatory rights that apply under Danish law.

For company bookings, the agreed quotation, invoice or event agreement may contain specific cancellation terms, which apply in addition to this policy.

Custom portraits are personalised artworks created specifically for you. Because they are made to order, different statutory rules may apply compared with standard paintings.

Cancellation before work has started

If you contact us before painting has begun, the commission can normally be cancelled and any amount paid refunded, less any clearly disclosed costs already incurred.

Cancellation after production has started

Once work on your personalised artwork has begun, the piece cannot be resold to anyone else. A refund may therefore be reduced by the work and materials already committed, or may not be available, as agreed for your commission.

Statutory exceptions

Under Danish consumer law, the ordinary 14-day online withdrawal right does not generally apply to goods made to the consumer's specifications or clearly personalised. Custom portraits normally fall within this exception. Where a statutory right nevertheless applies to your order, it takes precedence. This section is always subject to mandatory Danish consumer law, and your rights concerning defective work are unaffected.

The Painting & Wine Box is a physical product. You order it on the website, pay by bank transfer (or MobilePay where offered), and the Box is shipped to your address or collected from the studio by agreement. Shipping cost is agreed separately.

For online purchases the statutory withdrawal right normally applies:

• you normally have 14 days from receiving the Box to notify us that you wish to withdraw;
• you then normally have a further 14 days to return it;
• return shipping is paid by you, as disclosed here, where legally permitted;
• the Box should be returned complete, safely and appropriately packaged;
• you may be responsible for any reduction in value if the contents have been used or handled beyond what is necessary to inspect them, where permitted by law.

To return a Box, email alessia.artista@gmail.com and we will confirm the return address. If the Box arrives damaged or is defective, see the section below — in that case you should not be left carrying return costs that applicable law requires the studio to cover. Approved refunds are processed according to applicable Danish consumer law. No blanket "no refunds" rule applies.

Books and other physical products sold through the website are treated like any other online purchase: the statutory 14-day withdrawal right normally applies, followed by a further 14 days to return the item, with return shipping paid by you where legally permitted. Items should be returned in a condition that allows resale where possible. No special no-return rule applies to books.

If a product arrives damaged, or turns out to be defective, contact alessia.artista@gmail.com as soon as reasonably possible and include:

• your order number
• a description of the problem
• photos where relevant

We will agree the next step with you — repair, replacement, a price reduction or a refund — according to applicable Danish consumer law. Your statutory rights concerning defective products are not affected by this cancellation policy, and you are not asked to pay return costs where applicable law requires the studio to cover them.

• your full name
• your order number
• the product or workshop
• the purchase date
• the workshop date, if applicable
• what you would like to happen (withdrawal, return, transfer, reschedule or refund)

You do not need to give a reason when you exercise a statutory withdrawal right where no reason is required.

Approved refunds are processed according to applicable Danish consumer law. Refunds are not instant — please allow a reasonable processing time, and bank processing times on top of that.

• MobilePay payments are refunded through the appropriate MobilePay / studio payment procedure.
• Bank transfer payments are refunded to the appropriate customer bank account or payment route.

Payments are verified manually, and an order is never marked Paid until the payment has actually been verified.
